UARP PROTECTS PENSIONERS' INTERESTS IN THE CONSTITUTIONAL COURT OF UKRAINE

The efforts of the "Ukrainian Association of Retired Persons" to battle against draconian norms of the legislation in force regarding the repeal of pensions imposed on certain categories of pensioners in work have been awarded once again.

On April 12, 2016, the Constitutional Court of Ukraine adopted Regulation №21/ 2016 on the form of examining the case upon the constitutional recommendation of 49 Members of Parliament of Ukraine regarding the constitutionality of certain provisions of Section I, Paragraph 2, Part of Act III "Final Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Related to Pension Provision" dated March 2, 2015 №213-VIII (//zakon3.rada.gov.ua/laws/show/213-19).

It refers to the article: "The terms and conditions of pension payments (monthly lifetime allowance) applied to pensioners in work - established by this law - are applicable to pensioners (beneficiaries of monthly lifetime allowance) regardless of the time, when their pension was awarded."

According to Paragraph 2 of the above mentioned Regulation, the "Ukrainian Association of Retired Persons" has to be invited by the Constitutional Court of Ukraine to participate in the hearings of the case.

We will inform our readers about the course of proceedings.
